J. Moment v. The Secretary of State for India in Council.

အမှုတွင်တရားဝန်ကြီးချုပ်( Mr Fox )အပါအဝင်တရားသူကြီးများကအိန္ဒိယနိုင်ငံအက်ဥပဒေအမှတ်၄ဖြင့်အောက်မြန်မာပြည်မြို့နှင့်ကျေးရွာမြေများအက်ဥပဒေပုဒ်မ၄၁( ခ )ပါပြဌာန်းချက်များသည်၊ဥပဒေပြုအာဏာပိုင်အဖွဲ့၏ဥပဒေပြုရန်အခွင့်အာဏာဘောင်အတွင်းကျမကျနှင့်စည်းကျော်လွန်ခြင်းရှိမရှိစိစစ်ကြသည်။

ထိုစဉ်ကမြန်မာနိုင်ငံတနိုင်ငံလုံးကိုအင်္ဂလိပ်တို့ကသိမ်းပိုက်ပြီးဖြစ်သော်လည်း၊အောက်မြန်မာပြည်မြို့နှင့်ကျေးရွာမြေများအက်ဥပဒေနှင့်အထက်မြန်မာပြည်မြေနှင့်အခွန်တော်စည်းမျဉ်းဥပဒေနှစ်ရပ်ပြဌာန်းခဲ့သည့်အခါက၊အုပ်ချုပ်ရေးရှုထောင့်မှကြည့်၍ပြဌာန်းခဲ့ပုံပေါ်သည်။

အိန္ဒိယနိုင်ငံ East India Company ကသိမ်းပိုက်ခဲ့ရာမှထိုကုမ္ပဏီ၏အစိုးရလက်အောက်ရောက်သွားသည်။

၁၈၅၈ခုနှစ်၊အိန္ဒိယအစိုးရအက်ဥပဒေအရကုမ္ပဏီ၏အစိုးရလက်အောက်ရှိနယ်ပိုင်များမှာ၊ဘုရင်( The Crown )လက်အောက်သို့ရောက်ရှိသွားပုံကိုစီရင်ထုံးတွင်စိစစ်ကြသည်။

ထိုအက်ဥပဒေ(ပုဒ်မ၆၅ကိုစီရင်ထုံးတွင်အပြည့်အစုံဖော်ပြထားသည်)တွင်အရပ်သူအရပ်သားများက၊ကုမ္ပဏီအပေါ်တရားစွဲခွင့်ရှိသည့်နည်းတူ The Secretary of State for India in Council အပေါ်တွင်လည်းတရားစွဲခွင့်ရှိသည်ဟူသောပြဌာန်းချက်များကိုထောက်ပြကာ၊အချင်းဖြစ်ပုဒ်မ၄၁( ခ )ပါပြဌာန်းချက်တို့သည်၁၈၅၈ခုနှစ်၊အိန္ဒိယနိုင်ငံအစိုးရအက်ဥပဒေပုဒ်မ၆၅ပါပြဌာန်းချက်များကိုချိုးဖောက်သည်ဟုစုံညီခုံရုံးတရားဝန်ကြီးချုပ်နှင့်တရားသူကြီး( ၃ )ဦးကဆုံးဖြတ်သည်။

တရားသူကြီးချုပ်( Mr Fox )၏အဆုံးအဖြတ်ကိုစာမျက်နှာ၁၇၀တွင်အောက်ပါအတ်ုင်းဖော်ပြသည်-

“ That being so , I think that the answer to the question referred must be that the provision of section 41 of the Lower Burma Town and Village Lands Act , 1898 , that no Civil Court shall have jurisdiction to determine any claim to any right over land as against Government was ultra vires of the Legislative Council of the Lieutenant-Government of Burma , because it infringed the 65th section of the Government of India Act , 1858 , and the 22nd section of the Indian Councils Act 1861. “
